1.Special Administrative Measures (Negative List) for Foreign Investment Access in Pilot Free Trade Zones (2019 Version)

On June 30, 2019, the National Development and Reform Commission and the Ministry of Commerce jointly issued the Special Management Measures for Foreign Investment Access in the Pilot Free Trade Zone (Negative List)(2019 Version), which was put into implementation on July 30, 2019.

Based on the opening-up measures of the Special Administrative Measures (Negative List) for Foreign Investment Access (2019 Version), restrictions on the negative list of the Free Trade Zone (FTZ) for foreign investment in aquatic product fishing, publication printing and other fields will be removed, and opening-up and pilots will be expanded. The items have been cut down to 37 from the previous 45, thus, further downsizing the negative list in 2019. The negative list of the FTZ applies to all pilot free trade zones on mainland China, including the China (Sichuan) Pilot Free Trade Zone. The relevant opening-up measures include lifting the ban on investment in fishing for aquatic products in waters under China's jurisdiction and inland water, and lifting the restriction that printing of publications must be controlled by China.

It lists special administrative measures for foreign investment access such as equity requirements and executive requirements, while the fields not included on the list shall be treated the same as domestic investments. It also specifies the transition period for canceling or relaxing the access restrictions for some areas. After the transition period expires, the access restrictions will be canceled or relaxed on time.

2.Notice of Chongqing Municipal People's Government on the Implementation of the Notice by the State Council Regarding Several Measures for Supporting Pilot Free Trade Zones in Deepening Reform and Innovation

On March 18, 2019, Chongqing Municipal People’s Government issued the Notice of Chongqing Municipal People’s Government on the Implementation of the Notice by the State Council Regarding Several Measures for Supporting Pilot Free Trade Zones in Deepening Reform and Innovation. According to the notice, it is required for the leading group of China (Chongqing) Pilot Free Trade Zone (Chongqing Pilot Free Trade Zone) to play a role in overall planning and coordination to timely address problems during the implementation of measures taken by the State Council for supporting pilot free trade zones in deepening reform and innovation, strengthen daily supervision and inspection, conduct assessment on the performance of measures being taken, sum up and publicize outstanding experiences and cases, and improve the sense of gain of market entities. The government and open platform of the district where China (Chongqing) Pilot Free Trade Zone is located should be responsible for the implementation of supporting measures and their matchmaking with projects, so as to accelerate the fostering of new driving force.

3.Trial Measures for the Management of China (Chongqing) Pilot Free Trade Zone

On September 17, 2018, Chongqing Municipal People’s Government issued the Trial Measures for the Management of China (Chongqing) Pilot Free Trade Zone (hereinafter referred to as the Measures). The Measures has clarified the functions and responsibilities of the Leading Group of China (Chongqing) Pilot Free Trade Zone, the Office of China (Chongqing) Pilot Free Trade Zone, and regional governments, development zones and management institutions and relevant business departments of functional zones within China (Chongqing) Pilot Free Trade Zone; determined a system of pre-establishment national treatment and negative list management on foreign investment; proposed the direction and requirements for trade transformation and upgrading of China (Chongqing) Pilot Free Trade Zone; and enhanced the construction of financial risk prevention & control system with the establishment of financial risk monitoring and assessment mechanism, financial regulatory coordination mechanism, financial exchange market industry self-discipline mechanism, etc.

4.Notice of the Industrial Development Plan for China (Chongqing) Pilot Free Trade Zone (2018-2020)

On March 23, 2018, the General Office of Chongqing Municipal People’s Government issued the Notice of the Industrial Development Plan for China (Chongqing) Pilot Free Trade Zone (2018-2020). According to the notice, the overall goal of China (Chongqing) Pilot Free Trade Zone is to basically establish “One Hub, Three Centers and One Base”. The “One Hub” refers to an inland international logistics hub with multimodal transport as the core; the “Three Centers” include an international trade center focused on trading of goods, a key domestic functional financial center featuring settlement and clearing facilitation, and a modern service center aimed at boosting interconnectivity; the “One Base” means an important national modern manufacturing base supported by scientific and technological innovation. In consideration of development basis and geographic conditions, China (Chongqing) Pilot Free Trade Zone focuses on the development of seven industry clusters including advanced manufacturing, modern logistics, international commerce and trade, financial service, professional service, information service and cultural tourism, paying close attention to headquarters industries and emerging industries.

5.Overall Plan for Establishing China (Chongqing) Pilot Free Trade Zone

On March 31, 2017, the State Council issued the Overall Plan for Establishing China (Chongqing) Pilot Free Trade Zone. According to the overall plan, the China (Chongqing) Pilot Free Trade Zone will be established to make Chongqing play its role as a strategic pillar and a connection point, promote the opening-up of portal cities in Western China, and strive to build China (Chongqing) Pilot Free Trade Zone into a key hub achieving the interconnectivity of the Belt and Road and the Yangtze River Economic Belt as well as an important strategic pillar of the Western Development Strategy. Relevant schemes were proposed to clarify the scope, main tasks and measures of China (Chongqing) Pilot Free Trade Zone.

Scope of Implementation

The implementation area in China (Chongqing) Pilot Free Trade Zone (hereinafter referred to as the "CQFTZ") is 119.98 square kilometers, covering Liangjiang New Area of 66.29 square kilometers (including 8.37 square kilometers of Chongqing Lianglu-Cuntan Free Trade Port Area), Xiyong Area of 22.81 square kilometers (including 8.8 square kilometers of Chongqing Xiyong Comprehensive Bonded Zone and 0.15 square kilometer of Chongqing Railway Bonded Logistics Center (B)) and Guoyuangang Area of 30.88 square kilometers.

Strategic Positioning

The strategic positioning is to take system innovation as the core and the feasibility of replicability as the basic requirement, make Chongqing play its role as a strategic pillar and a connection point, promote the opening-up of portal cities in western China, and strive to build CQFTZ into a key hub achieving the connectivity of the Belt and Road and the Yangtze River Economic Belt as well as an important strategic pillar of the Western Development Strategy.

Development Goals

Through three to five years of reform and exploration, it is expected to build a high-level and high-standard free trade park with convenient investment and trade, gathering of high-end industries, efficient and convenient supervision, perfect financial services, standardized legal environment and prominent radiation-driven role, strive to establish an international logistics hub and port highland that will serve the construction of the Belt and Road and the development of the Yangtze River Economic Belt, push forward to form a new pattern of all-round opening-up of portal cities in western China and drive the in-depth implementation of the Western Development Strategy.
